DUI Blow or Refuse

I am a Miami DUI attorney handling DUIs. Many people constantly ask me whether, in the event they are arrested for a DUI, they should blow or refuse. What every client should know is the law and the consequence of either refusing or blowing and make their decision knowingly.

In Florida, if someone is arrested for a DUI, they will be requested to provide a breath sample. In the event they refuse to provide a breath sample, their driver's license will be suspended for 1 year for a first DUI. If they were to provide a breath sample and it was over the legal limit of .08, the suspension would be for 6 months as opposed to 1 year for refusing.

In addition, if someone has had a prior refusal to provide a breath or urine sample, then a subsequent refusal can become an additional crime.
