Attorney Michael Mirer Secures Not Guilty Verdict in Weapons Possession Case

Law Office of Michael Mirer, P.A. is pleased to announce that Attorney Mirer has again secured a favorable case result on behalf of a client. In a recent trial, Attorney Mirer successfully argued for a not guilty verdict on a possession of a firearm by a convicted felon charge by challenging probable cause and search and seizure issues with the initial arrest.

Attorney Mirer's client was pulled over in a traffic stop. The arresting officer later testified that the accused had a firearm in plain sight and arrested him for possession of a firearm by a convicted felon (Florida Statute 790.23). The officer also testified that the accused confessed to owning the gun for his own protection.

Much of this account, however, was challenged in the trial. Attorney Mirer's incisive defense strategy not only established that the arresting officer was not credible, but that the firearm's position in the vehicle was not in "plain view." The jury agreed and came back with a not guilty verdict, saving the accused from a 10-year prison sentence.

Search & Seizure Violations

When it comes to possession charges (firearms, drugs, etc.), Fourth Amendment Rights have to be made an absolute priority. The Fourth Amendment protects citizens from unlawful searches and seizures. In this case, it was clear that a routine traffic stop could not have reasonably yielded a possession of firearm charge.
