What are the Penalties for Perjury?

Under Florida law, the charges and consequences for perjury vary depending upon the circumstances involved in the alleged offense. The more serious the proceeding in which the perjury occurred, the more seriously the crime will be charged.

Perjury in a non-official proceeding is a first-degree misdemeanor, punishable by:

Perjury in an official proceeding is a third-degree felony, punishable by:

  • Maximum sentence of 5 years in state prison
  • Up to $5,000 in fines

Perjury in an official proceeding related to the prosecution of a capital felony is a-second degree felony, punishable by:

  • Maximum sentence of 15 years in state prison
  • Up to $10,000 in fines
