Escape Your Kidnapping Charges

Florida Kidnapping Charges - FL Code, Section 787.01

Miami Criminal Defense Attorney

Kidnapping is a violent crime that is charged as a first degree felony offense in Florida, and a defendant convicted of this offense may face up to 30 years to life in state prison.

The specific circumstances of the offense, the age of the victim and several other factors will influence the charges and penalties that a defendant is faced with in regard to kidnapping. Kidnapping may also be charged as a federal crime if the defendant is accused of taking the victim across state lines.

Florida Kidnapping Charges and Penalties

Florida Code, Section 787.01 defines kidnapping as, "…forcibly, secretly, or by threat confining, abducting, or imprisoning another person against his or her will and without lawful authority…" with the intent to hold for ransom, use as a shield or hostage, commit a felony offense, physically injure the victim, or interfere with any governmental function.

Kidnapping as defined in this section or involving the confinement of a child under the age of 13 is a first degree felony offense and may be punishable by up to life in prison, or by up to 30 years in state prison and/or a fine of up to $10,000.

Lesser forms of kidnapping are referred to as "false imprisonment" and include holding a person against their will but not for the purpose of collecting ransom, of causing injury or of committing a felony offense. False imprisonment in this sense is a third degree felony, punishable by up to 5 years in prison and a fine of up to $5,000.
