Florida Kidnapping Laws

Florida Code, Section 787.01 defines kidnapping as, "…forcibly, secretly, or by threat confining, abducting, or imprisoning another person against his or her will and without lawful authority…" with the intent to hold for ransom, use as a shield or hostage, commit a felony offense, physically injure the victim, or interfere with any governmental function.

What are the Charges for Kidnapping?

Kidnapping as defined in this section of the Florida Code involves the confinement of a child under the age of 13 is a first degree felony offense and may be punishable by:

  • Up to life in prison, or by up to 30 years in state prison
  • Fine of up to $10,000

False Imprisonment Charge Florida

Lesser forms of kidnapping are referred to as "false imprisonment" and include holding a person against their will but not for the purpose of collecting ransom, of causing injury or of committing a felony offense. False imprisonment in this sense is a third degree felony, punishable by up to 5 years in prison and a fine of up to $5,000.
