  • Use or Possession of Drug Paraphernalia — First degree misdemeanor punishable by up to 1 year in jail and/or a fine of up to $1,000. Penalties increase with each subsequent offense.
  • Manufacture or Delivery of Drug Paraphernalia — Third degree felony punishable by up to 5 years in prison and/or a fine of up to $5,000. Penalties increase with each subsequent offense.
  • Delivery of Drug Paraphernalia to a Minor — Second degree felony punishable by up to 15 years in prison and/or a fine of up to $10,000. Penalties increase with each subsequent offense.
  • Transportation of Drug Paraphernalia — Third degree felony punishable by up to 5 years in prison and/or a fine of up to $5,000. Penalties increase with each subsequent offense.
  • Advertisement of Drug Paraphernalia —First degree misdemeanor punishable by up to 1 year in jail and/or a fine of up to $1,000. Penalties increase with each subsequent offense.
  • Retail Sale of Drug Paraphernalia — First degree misdemeanor punishable by up to 1 year in jail and/or a fine of up to $1,000 for the first offense. Penalties increase with each subsequent offense.
